These Terms of Service (“Terms”) govern your use of Digital Stockist (the “Marketplace”), operated by Spabi Exim (OPC) Private Limited (CIN: U51909MH2020OPC346301) (“we,” “us”), including buying, downloading, and selling digital files. By creating an account or using the Marketplace, you agree to these Terms.
1. The Marketplace
Digital Stockist is a marketplace where independent creators (“Sellers”) offer digital files such as graphics, templates, craft files, and printables to buyers (“Buyers”). Unless a listing says otherwise, files are created and owned by Sellers, not by Digital Stockist.
2. Accounts
You need an account to buy, download, or sell. You must give accurate information, keep your login details secure, and are responsible for activity on your account. You must be at least 18, or the age of majority where you live, to sell.
3. Buying
- Single Purchase listings are bought once, at the price shown.
- Subscription listings are downloaded using the allowance of a download plan. Each download uses one from your plan; files you have already unlocked stay available in your account.
- Every file is licensed, not sold. Your rights are set by the license shown on the listing and our Licensing Terms.
- Prices are shown in US dollars. Taxes may apply based on your location.
4. Refunds
Because files are delivered instantly, refunds are limited. See our Refund Policy.
5. Selling
- You may only list work you created or have the full right to sell and license.
- Every listing is reviewed before it is published. We may decline, edit the placement of, or remove any listing at our discretion.
- Sellers receive 70% of each Single Purchase sale. Digital Stockist retains a 30% fee. For Subscription listings, Sellers earn the per-download amount set for each plan.
- Earnings are recorded in your dashboard Wallet, and payouts are requested from there.
- By listing a file, you grant Digital Stockist a non-exclusive right to host, display, promote, and deliver it to Buyers, and to create previews of it.
6. Prohibited content and conduct
You may not upload or sell content that infringes anyone’s rights, is illegal, hateful, sexually explicit, or harmful, or contains malware. You may not resell or redistribute files from the Marketplace except as the license allows, misuse the review or payment systems, or interfere with the Marketplace.
7. Intellectual property
Sellers keep ownership of their work. The Digital Stockist name, design, and software belong to Digital Stockist. To report infringement, see our DMCA / Copyright Policy.
8. Suspension and termination
We may suspend or close accounts that break these Terms. You may close your account at any time. Licenses to files you purchased continue after your account closes, subject to their terms.
9. Disclaimers and liability
The Marketplace is provided “as is.” To the fullest extent permitted by law, Digital Stockist is not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
10. Changes
We may update these Terms. We’ll post the new version here with an updated date. Continuing to use the Marketplace means you accept the changes.
